New Land Trust. Set up of a land trust of one property and one or two beneficiaries, including trust (or amendment to existing trust), deed, and related documentation, including trustee's fee for first year or fraction thereof:
A Full Service Land Trust setup is $500. This includes up to an hour of time with us on the phone or in our office, and with us calling title companies or lenders to smooth out the transaction when necessary. It includes preparing the Land Trust Agreement, Direction to Trustee, and the Deed to Trustee where necessary. If you have never done a land trust and have questions about the setup and operation of the trust, you would be best served by this package.
An Extra Service Land Trust set up is $750. This would be a full service land trust where you need immediate service or evening or weekend service or have any other special issues or needs that require extra work.
An Economy Land Trust setup is $300. This includes the same documentation as a full service land trust but is for persons who do not need any telephone time with us. You send us the setup forms and we send you the trust and send to the closing agent the necessary instructions and documentation. If you are familiar with land trusts and do not need to use our time on the phone, this package would be best. We would answer questions by email for free.
Consultation on trust setup. If you have quick questions about your land trust we can answer them for free by email, but if you want to go into detail about different structures or more creative ways to use the land trust we can consult in our office or by phone. Per one-half hour or fraction thereof: $100.00
Assignment from seller. When we set up the trust in the seller's name and prepare the assignment, Form 56, explanation letter to closing agent, and provide Forms DR-228 and DR-430 with explanation the fee is $100.00
Annual trustee fee for future year or fraction thereof, if paid on time, includes forwarding of tax notices and important mail and disposal of junk mail $100.00. If not paid within 30 days we charge a $5 per month bookkeeping fee.
Additional land trust. Set up of an additional land trust for an existing client with same parties as existing trust would be entitled to a $50 discount from original trust setup fees above.
Additional setup fee for adding parcels to a trust. (Because all trust properties can be liable for an accident on one property, only adjacent parcels of vacant land should be combined in one trust. Other properties should be in separate trusts.) $150.00Additional annual fee for additional parcel in the same trust $100.00
Amendment to Trust. Preparing and accepting an amendment to a trust (such as changing or adding successors) $50.00
Receipt and forwarding of service of process $25.00
Receipt and forwarding of registered and certified mail $10.00
Letter to government official. If your property is in violation of some law and we receive a government notice which threatens to affect other properties of our other clients and we must write to the government agency to correct this problem there is a fee of $35.00
Letter of Authorization. Usually you can show your trust agreement to homeowner associations or contractors to prove your authority over the property, but if you would prefer a letter from us authorizing you to manage and control the property the fee for preparing and signing the letter and direction to trustee is $35.00
Signing loan or similar documents at notary. If you need a document notarized for your trust, such as a mortgage or notice of commencement, our fee is usually $50.00 which includes the time going to a notary and giving you a direction to trustee form to sign to authorize us to sign.Sale of property from trust, including preparation of direction to trustee, IRS Form 56 and execution of closing documents $100.00
In cases where are numerous loan documents that need to be printed, reviewed and signed at the notary the fee depends on the time involved, at $200 per hour.
Needing to review and have extra papers notarized after a closing package has been completed $50.00
Extra time needing to be spent negotiating with closing agents or attorneys regarding incorrect forms or procedures (refusing to make proceeds check to beneficiary) will be billed for time involved at $200.00 an hour. In Miami-Dade County the buyer usually chooses the closing agent so there are often problems with those closings. We have an in-house closing agent which can usually save you money and aggravation with your closing.
Deeding property to beneficiary, including preparation of direction to trustee, IRS Form 56 and execution of deed at notary $50.00 (plus recording fee)
Transfer of beneficial interest, including Assignment, Form 56 and Preparing form DR-228 (stamp taxes extra) $100.00
Assignment to spouse or your own LLC $50.00
- Emergency fee. We can usually prepare trust papers within a day or two and this works for most of our clients. But when a client must have something prepared the same day and we must stop everything else we are doing there is an emergency fee of $100
- Please keep in mind that we are sometimes out of town lecturing or giving seminars so it is best to contact us at least a week in advance of any closing.
- You should advise your title company to contact us in advance.
